Elokuun 26. päivän jälkeen 295 valmistajaa on saanut MDO-todistuksen yli 1 089 000 tuotteelle.Sen jälkeen, kun luvattomat tuotteet on poistettava markkinoilta 9. syyskuuta, FDA:n tupakkatuotekeskus ei ole antanut lupaa e-savuketuotteiden markkinointiin. PMTA:n hylkäämät tuotteet tulee poistaa markkinoilta tai FDA:n on määrättävä niihin lisävalvontaa.FDA ilmoitti, että sen tärkeimpiin täytäntöönpanotoimiin kuuluvat tuotteet, jotka ovat saaneet MDO:n tai joita ei ole koskaan lähetetty tarkistettavaksi.Kaikki tällä hetkellä saatavilla olevat tuotteet ovat kuitenkin edelleen teknisesti FDA:n valvonnan alaisia, mukaan lukien massamarkkinoiden sähkösavukkeiden valmistajat, kuten Juul Labs ja Reynolds American's Vuse -brändi.

Ensimmäisellä MDO-kierroksella FDA ilmoitti aiemmin julkaisemattomasta standardista, joka edellyttää PMTA:n käyttöä muiden tuotteiden kuin tupakan ja mentolin maustamiseen osoittaakseen, että riittävä tuotekohtainen tieteellinen näyttö osoittaa riittäviä etuja aikuisille tupakoitsijoille.Voittaa tupakan ja mentolin riskit.
